DMCA & Content Removal

Memoria respects the intellectual property rights of others and takes copyright infringement seriously. We comply with the Digital Millennium Copyright Act (DMCA) and respond to valid takedown notices promptly. This page describes our process for copyright complaints, counter-notices, and Right of Kin removal requests.

1. Copyright Infringement Notice (DMCA Takedown)

If you believe content on Memoria infringes your copyright, please submit a written notice to our designated agent at legal@memoriahq.com. To be valid under 17 U.S.C. ยง 512(c)(3), your notice must include all of the following:

  • A physical or electronic signature of the copyright owner or an authorized agent.
  • Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are covered).
  • Identification of the material claimed to be infringing, with sufficient information for us to locate it (e.g., the URL of the memorial page and a description of the specific content).
  • Your contact information, including name, address, telephone number, and email address.
  • A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Response time: We will acknowledge receipt within 2 business days and act on valid notices within 5 business days.

2. Counter-Notice Process

If you believe content was removed due to a mistaken or misidentified copyright claim, you may submit a counter-notice to legal@memoriahq.com. A valid counter-notice must include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed and its location before removal.
  • A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Los Angeles County, California if your address is outside the United States), and that you will accept service of process from the person who provided the original infringement notice.

Upon receipt of a valid counter-notice, we will notify the original complainant and may restore the content after 10โ€“14 business days, unless the complainant seeks a court order.

3. Right of Kin โ€” Memorial Removal Request

We understand that encountering a loved one's memorial page unexpectedly, or finding content you consider inaccurate or distressing, can be deeply painful. We have a dedicated process for next-of-kin and immediate family members to request removal of a memorial page or specific content.

Who may request removal?

  • Spouse, domestic partner, or civil partner of the deceased
  • Children (including adopted children) of the deceased
  • Parents or legal guardians of the deceased
  • Siblings of the deceased
  • Legal representative of the deceased's estate

What can be requested?

  • Removal of the entire memorial page
  • Removal of specific photos, audio, or video content
  • Removal of specific written memories deemed inaccurate, harmful, or distressing
  • Correction of factual errors about the deceased (dates, name, etc.)

How to submit a request

Use our Right of Kin Removal Request form or email legal@memoriahq.com with the subject line "Kin Removal Request" and include:

  • Your full name and contact email
  • Your relationship to the deceased
  • The full name of the deceased and the URL of the memorial page
  • A description of the content you wish removed and the reason
  • Proof of your relationship: a copy of a death certificate, government-issued ID, or other official documentation

Response time: We will acknowledge your request within 2 business days and make a determination within 5 business days of receiving adequate documentation. We may require additional verification for disputed requests.

4. Repeat Infringer Policy

Memoria will terminate the accounts of users who are determined to be repeat copyright infringers in appropriate circumstances.
